GALVESTON — Galveston City Council Member Jason Hardcastle was arrested Friday evening following a two-vehicle crash on Seawall Boulevard, facing charges of driving while intoxicated and resisting arrest, according to the Galveston Police Department.
Officers responded to the crash at approximately 8:15 p.m. Oct. 30 in the 6800 block of Seawall Boulevard. Police said no injuries were reported.
During the investigation, an officer observed signs of possible intoxication involving Hardcastle, according to the department. Following further investigation, Hardcastle was arrested on suspicion of driving while intoxicated, a Class B misdemeanor.
Police said Hardcastle declined to provide a breath sample. Officers subsequently obtained a search warrant for a blood specimen, which was to be collected by a trained medical professional at a local hospital.
While officers were executing the warrant at the hospital, Hardcastle allegedly physically resisted their efforts, resulting in an additional charge of resisting arrest, search or transportation, a Class A misdemeanor, police said.
Hardcastle was booked into the Galveston County Jail. His bond was set at $1,000 for the DWI charge and $1,500 for the resisting charge.
Attorney Jonathan Zendeh Del said his firm, Zendeh Del & Associates, PLLC, will represent Hardcastle and has begun reviewing the evidence and circumstances surrounding the arrest.
In a statement provided to KGTX 7, Zendeh Del said the defense intends to challenge the allegations, including the scientific evidence and constitutional issues involved in the case. He also emphasized that consuming alcohol and driving does not, by itself, constitute a DWI offense under Texas law.
“We anticipate a lengthy legal process and intend to vigorously challenge the allegations against Mr. Hardcastle,” Zendeh Del said.
The attorney also described Hardcastle as a longtime member of the community who has never previously been arrested.
The allegations have not been adjudicated in court.
