GALVESTON — A Galveston County grand jury took no action against a Galveston police officer in the May 18 shooting death of Randy Martin after receiving evidence that included video of the incident, according to a statement provided to KGTX 7 by the district attorney’s office.

The Galveston County District Attorney’s Office presented the case Tuesday, Sept. 8, following an investigation by the Texas Rangers. The office said only grand jury members were present during deliberations.

Although video was among the evidence presented, the recordings have not been released publicly, according to i45NOW. The outlet reported that Martin’s family and their attorney also have not been allowed to review the footage.

A separate internal affairs investigation remains open, Galveston Police Chief Douglas Balli told i45NOW. Balli said the department is awaiting the Texas Rangers’ investigative report before proceeding with its review.

The officer was identified as Officer Joshua Nino and is currently assigned to the department’s Support Services Bureau, which handles training, recruiting and logistical support.

Martin, 47, was fatally shot during a traffic stop. According to i45NOW’s reporting on the officer’s account, Nino told investigators that Martin struggled with him and repeatedly tried to reach for his gun before the officer fired.

Martin’s girlfriend has publicly disputed that account, saying he did not resist or reach for the weapon. The district attorney’s statement did not describe what the video showed or provide a detailed account of the encounter.
