Galveston Man Pleads Guilty in Elderly Assault, Receives Six-Year Sentence

PORT ARTHUR — A Galveston man was sentenced to six years in prison after pleading guilty in connection with the assault of an elderly woman last year.

Avery Jermaine Desselles, 43, pleaded guilty to injury to an elderly person, a third-degree felony. Judge Stevens imposed the six-year sentence as part of a plea agreement with prosecutors and granted credit for time already served. Court records show Desselles was indicted on Aug. 13, 2025.

If the case had gone to trial and resulted in a conviction, Desselles could have faced a sentence ranging from two to 10 years in prison and a fine of up to $10,000.

According to a probable cause affidavit, the incident occurred in May 2025 in the 8100 block of Honeywood Trail in Port Arthur. The 66-year-old woman was walking from her car to her apartment using a walker when she encountered Desselles.

Investigators wrote that Desselles appeared to be in medical distress and asked the woman for help. The affidavit states she offered to call an ambulance, but he declined and became upset after she said that was all she could do. Authorities allege Desselles then struck her with a closed fist. The affidavit notes the walker prevented her from falling.

Desselles remained in custody following sentencing.
